1. About These Terms

These Terms of Service (“Terms”) govern your use of the Music Tech Hub website (musictechhub.org) and all associated resources, member content, and web applications (“the Service”), provided by Music Tech Hub Ltd (“we”, “us”, “our”).

By creating an account, purchasing a subscription, or accessing any part of the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Who Can Use the Service

The Service is intended for adults aged 18 and over, specifically:

• Classroom teachers and music specialists
• Music education hub and music service staff
• School leaders and senior leaders
• Other music education professionals

If you are purchasing or accessing the Service on behalf of a school, music service, or other organisation, you confirm that you have authority to agree to these Terms on their behalf.

The Service is not intended for direct use by children or young people except where a supervising teacher uses our web applications in a classroom setting in accordance with our Safeguarding & Child Safety Statement.

3. Accounts and Registration

To access member content and web applications, you must create an account using the eMember registration system on our website.

You agree to:

• Provide accurate and complete information when registering
• Keep your login credentials secure and not share them with others
• Notify us promptly if you believe your account has been compromised
• Use one account per individual (institutional licences are available – see Section 5)

We reserve the right to suspend or close accounts that appear to be shared, misused, or in breach of these Terms.

4. Free Content

Certain content on the Music Tech Hub website is available without registration, including sample lessons, free browser-based music apps, and publicly listed resources. This content may be used freely for non-commercial educational purposes. You may not reproduce, redistribute, or publish free content for commercial gain without our written permission.

5. Paid Subscriptions and Licences

5a. What Your Subscription Covers

A paid Music Tech Hub subscription grants you access to:

• Curriculum-aligned schemes of work, lesson slides, and supporting materials
• Access to web applications associated with your purchased resources
• Any other content specified at the point of purchase

5b. Licence Terms

Your subscription is a non-exclusive, non-transferable licence for use by the named account holder only, unless an institutional or multi-user licence has been purchased.

You may use licensed content to deliver lessons and training within your school or organisation. You may not:

• Share, resell, or sublicense resources to third parties
• Upload or redistribute our materials to shared platforms, resource marketplaces, or public repositories
• Remove or obscure any Music Tech Hub branding or attribution from resources
• Use our resources as the basis for competing products or services

5c. Institutional Licences

Where a music service, hub, or school purchases access covering multiple users or schools, the specific terms and number of permitted users will be confirmed in writing at the time of purchase and form part of these Terms.

5d. Payment and Renewal

Subscription fees are payable in advance. Pricing is as stated on our website at the time of purchase. We will give reasonable notice of any price changes before your renewal date.

If a payment fails, access to paid content may be suspended until payment is resolved.

5e. Refunds

We offer a 14-day cooling-off period from the date of first purchase, provided you have not accessed the paid content. To request a refund, contact bradley@musictechhub.org within 14 days of purchase.

After the cooling-off period, or once paid content has been accessed, refunds are at our discretion.

6. Web Application Access

Access to our browser-based web applications (“the Apps”) is granted to authorised users as part of specific paid resource packages.

Access is managed by a separate system (Supabase/Cloudflare) in which your email address is used to verify your permission level. This is a distinct system from your eMember website account, though linked by email address.

6a. Teacher Session Codes

When using the Apps with pupils, teachers generate a session code that allows children to access the App without providing any personal information. The teacher is responsible for appropriate supervision during all pupil use of the Apps.

6b. Acceptable Use

You agree not to:

• Attempt to bypass, reverse-engineer, or exploit any part of the Apps or access control system
• Use the Apps in a way that could harm, distress, or expose children or other users to inappropriate content
• Use the Apps for any purpose other than music education

7. Intellectual Property

All content on the Music Tech Hub website and in our resources and applications – including schemes of work, lesson materials, video content, graphic design, and software – is the intellectual property of Music Tech Hub Ltd or its licensors.

Nothing in these Terms transfers any intellectual property rights to you. Your subscription grants you a licence to use the content, not to own it.

8. Our Liability

We take care to ensure our content and applications are accurate, functional, and appropriate for use. However:

• We do not guarantee that the Service will be available at all times or free from errors
• We are not responsible for how our resources are used within your school or organisation – that responsibility rests with the supervising professional
• To the extent permitted by law, our liability for any claim arising from use of the Service is limited to the amount you paid for your subscription in the 12 months preceding the claim

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law.

9. Changes to the Service

We may update, add to, or withdraw content and features from the Service at any time. Where a significant feature is removed that formed part of your active subscription, we will notify you and offer a proportionate remedy.

10. Termination

You may cancel your account at any time by contacting bradley@musictechhub.org. Access to paid content will continue until the end of your current subscription period.

We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity of the breach.

11. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers by email of any material changes. Continued use of the Service after notification constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
